"To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;"
Letters of Marque aren't issued to navies. They're issued to non-government ship owners. Non-government warships.
This also underscores that the right to arms doesn't stop at small arms.
