Call Me Cynical

The Florida Supreme Court has unanimously decided that cops are protected by "stand your ground".

Why is it my spidy-sense is tingling that before too long we're going to be hearing that ONLY the police are so protected?

I've been hearing about how this decision essentially forces the cops and their professional organizations to join with us in applying the law as it is written.

But cop orgs don't work like that.  They want to be special.  Better than the people whom they purportedly serve.

  1. You can put your spidey senses down, at least when it comes to the Judicial side. The court simply clarified that cops are persons just like any other Floridian and they can benefit from Immunity from prosecution same as anybody else.


    More importantly, what Deputy Peraza is asserting here is not simply a
    defense. Deputy Peraza is asserting immunity from prosecution. Therefore, the

    real question, clearly and precisely framed, is whether Deputy Peraza is “immune
    from criminal prosecution” such that he is entitled to a pretrial immunity
    determination. That immunity is addressed only in section 776.032(1), which
    plainly says that the immunity is afforded to any “person who uses force as
    permitted in s. 776.012.” § 776.032(1). The State has pointed to no language from
    any statute, including section 776.05, that could reasonably be read as negating the
    plain and unambiguous language of the only statute affording the pretrial immunity
    determination that Deputy Peraza seeks.

    IANAL, but the decision affirms and confirms the status of SYG even more. This might be the second or third Florida supreme court decision in favor of SYG cases. It will get harder for Gun Control to plea removal via Judiciary

    1. There was once a time when the cops were held to a higher standard... then slowly but surely the laws which were supposed to protect us citizens were altered to no long apply to us.
